01Scope
These Terms of Use («Terms») govern the use of the «GymiReady» web app at gymi-ready.ch (the «App» or «Service»).
The provider is:

The contract is formed as soon as we confirm your registration or unlock paid access. By using the App you accept these Terms; if you do not agree, you may not use the App. Deviating terms apply only if we have agreed to them in writing.
02Description of the service
GymiReady is a study companion for parents that supports the preparation of their child for the Gymnasium entrance examination (Langgymnasium) in the cantons of Zurich and St. Gallen. The App offers, among other things:
- Competency tracking based on Lehrplan 21
- Diagnostic competency checks in Mathematics and German
- Personalised Mathematics worksheets
- Piko: AI-assisted practice with a friendly learning companion
- Exam simulations for the 6th grade
- Weekly planning and task management
- Progress overview and grade tracking
GymiReady is not an official educational offering and replaces neither school lessons nor professional tutoring. All content serves solely to support parents in guiding their child's learning.
No exam success owed. We owe the provision of the App, not the passing of an examination. Admission to the Gymnasium is decided solely by the competent cantonal authorities on the basis of the official entrance examination, in which we are not involved. Points, evaluations and assessments in the App are practice aids and not an assurance of any result.
Our content is based on the publicly available information about the cantonal entrance examinations — in particular the official examination requirements and Lehrplan 21. We reproduce it to the best of our knowledge and on the basis of that publicly available information; only the official information of the cantons is binding.
03Eligibility
The App is intended for parents and legal guardians. You must be at least 18 years old and have full legal capacity to create an account or enter into a subscription.
Children use the App — in particular Piko — solely under the supervision and responsibility of their parents or legal guardians. The account is personal and non-transferable; it may not be shared or resold.
04Account and sign-in
Using GymiReady requires an account and an active subscription or a running trial (§5). Sign-in is via a magic link sent to your e-mail address; no password is set.
You are responsible for protecting access to your e-mail and for all activity under your account. If you suspect that third parties have access to your account, please inform us promptly. You undertake to provide a valid e-mail address and not to give false information.
Your child's learning data is stored primarily on your device («local first»); synchronisation and backup are optional features (see privacy policy).
05Trial and subscription
7-day trial. At purchase you can start a free 7-day trial with the full range of features. A payment method must be provided to start it. The trial automatically converts into the chosen paid subscription after 7 days unless you cancel beforehand. If you cancel during the trial, no charge is made. The exact follow-on price is shown before purchase.
Prices. The prices shown at purchase apply. All amounts are in Swiss francs; any statutory VAT is included. Optional add-ons (e.g. «EU data processing») and discounts (e.g. for additional children) are shown at purchase.
Payment. Payments are processed by our payment provider Stripe. We do not see or store card or payment details (see privacy policy). Receipts are made available by Stripe in the payment portal, which you open from your account.
Renewal. The subscription renews automatically for the chosen period (monthly or yearly) until cancelled.
Payment default. If a due payment fails (e.g. because a charge is declined), access is suspended until payment is made up. We notify you by e-mail and retry the charge automatically.
06Cancellation and refunds
Cancellation by you. You can cancel your subscription at any time — via the payment portal (from your account) or by an informal message to us. The subscription continues until the end of the period already paid for; after that, access ends and there is no further automatic renewal. Locally stored learning data remains; server-side data is deleted in accordance with the privacy policy (account lifecycle: deactivation, then deletion after 30 days).
Price changes. We reserve the right to adjust prices. Changes are announced at least 30 days in advance and apply only from the next renewal period. If you disagree, you can cancel before they take effect.
Refunds. A purchase is binding: access is unlocked immediately, and there is no right to a refund on a mere change of mind. If you would like to try GymiReady first, use the free 7-day trial (§5) — you can cancel at no cost any time before it ends. Amounts already paid for a current period are not refunded, unless the law provides otherwise. Your mandatory statutory rights, and a pro-rata refund if a paid feature is permanently and substantially discontinued (§10), remain unaffected.
Termination for cause. Both parties may terminate the contract for good cause without notice. For us, good cause exists in particular in the event of misuse, sharing or resale of access, unauthorised distribution of content, or non-payment.
07Permitted use and obligations
You may use the App solely for its intended purpose — supporting your child's exam preparation. The following applies:
- No resale, no commercial use of access or content.
- No circumvention of security measures and no unauthorised access to others' accounts or server data.
- No systematic extraction (scraping), copying, mirroring or redistribution of content (questions, tasks, texts, worksheets).
- No disruption of operations — no overloading and no interference with the platform's technology.
- No misuse of Piko for purposes other than the intended learning support.
- No harmful or offensive content — no malware, spam, or abusive or inappropriate input.
- Own content — uploaded texts and photos (e.g. for handwriting recognition) must be yours or your child's, or you must be entitled to upload them.
We may remove content that violates these rules. Violations may lead to temporary suspension or termination of the account (§6).
08Intellectual property and your content
All content of the App — in particular questions, tasks, worksheets, texts, graphics, the design of the Piko character and the software — is protected by copyright (Art. 2 URG) and owned by GymiReady or used with the rights holders' permission. You are granted a simple, non-transferable and revocable right to use it for your child's personal preparation.
Your content. What you create in the App — notes, reflections and feedback messages — remains your property. We process this content only insofar as necessary to operate the App. By sending feedback, you grant us the right to use it to improve the App (without personal reference).
09Data protection
How we handle personal data, which data we process and with whom it is shared is set out in our privacy policy. It forms part of these Terms. Please read it carefully.
10Availability and further development
We strive for the most continuous operation possible but do not owe any specific availability. Maintenance, disruptions at upstream providers and circumstances beyond our control may lead to interruptions.
Because GymiReady stores learning data primarily locally («local first»), many features remain usable without an internet connection. The AI features (Piko), however, require an internet connection.
We develop the App on an ongoing basis and may change or discontinue individual features. If a paid feature is permanently and substantially discontinued, you may terminate the contract; we will then refund amounts already paid on a pro-rata basis.
11AI-generated content (Piko)
Piko is an AI-assisted learning companion. You acknowledge that:
- Piko's responses are AI-generated and may contain errors;
- Piko is not a substitute for a teacher or specialist;
- Piko's feedback and assessments are purely informative and do not constitute a binding evaluation;
- parents are responsible for reviewing the content Piko provides.
We employ safeguards and human-review controls to minimise errors as far as possible. With AI-generated content, however, errors cannot be entirely ruled out. Your feedback is therefore important to us: if you consider a Piko answer or assessment to be inaccurate, please report it via the feedback function — we review it and correct it if it is wrong.
In production, no full conversation transcripts of Piko sessions are stored — only a short summary of the session. Where and how session content is processed during a session is described in the privacy policy (§7).
12Limitation of liability
To the extent permitted by law, we limit our liability as follows. GymiReady is not liable for:
- academic results or the outcome of the entrance examination — the App is a tool; exam success depends on many factors (§2);
- data loss due to browser errors, device defects or cleared local storage — we recommend activating the optional encrypted backup or synchronisation;
- errors in AI-generated content (Piko responses, assessments, evaluations; §11);
- damage caused by force majeure, third-party services or circumstances beyond our control.
Otherwise, liability for slight negligence as well as for indirect and consequential damage is excluded to the extent permitted by law. Liability for personal injury and for intent and gross negligence is not excluded (Art. 100 para. 1 OR).
Where liability exists, it is in any case limited to the amount you paid for using the App in the last 12 months.
13Account deletion and termination
You can delete your account at any time — in the settings or by e-mail to privacy@gymi-ready.ch. After deletion, server-side data is deleted in full within 30 days. Excepted are payment and invoice records, which we retain in blocked form due to statutory retention obligations (see privacy policy §9).
When your subscription expires or is cancelled, the account is deactivated; the learning data is retained during a 30-day grace period and then automatically deleted.
We reserve the right to suspend or terminate accounts that violate these Terms. In serious cases (e.g. misuse or a security threat), this may occur without prior notice (§6).
14Changes to these terms
We may amend these Terms, for example when features, prices or legal requirements change. We will announce material changes at least 30 days in advance by e-mail or as a notice in the App. Anyone who disagrees with a change may terminate the contract before it takes effect; continued use after it takes effect constitutes acceptance.
15Governing law and jurisdiction
These Terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.
The exclusive place of jurisdiction for all disputes is Zurich, Switzerland, to the extent permitted by law. Mandatory statutory places of jurisdiction, in particular in favour of consumers (Art. 32 ZPO), remain reserved.
16Severability
Should any provision of these Terms be invalid or unenforceable, the remaining provisions remain unaffected. The invalid provision is replaced by a rule that comes as close as possible to the economic purpose of the invalid provision.
You may transfer rights and obligations under this contract to third parties only with our written consent.
